Before the NIW, there must be EB-2 eligibility.
A national interest waiver is part of the employment-based second preference classification. The petitioner therefore must first establish eligibility for EB-2 as a member of the professions holding an advanced degree or as a person of exceptional ability.
An RFE can challenge this threshold requirement separately from the national interest waiver itself. The response should therefore determine whether USCIS is questioning the degree, qualifying experience, exceptional ability evidence, or the relationship between the person's qualifications and the proposed endeavor.
Only after underlying EB-2 eligibility is established does the analysis turn to whether the job offer and labor certification requirements should be waived in the national interest.
Which national interest waiver prong is at issue?
The three prongs address different questions and should not be blended together in the RFE response.
Substantial Merit & National Importance
The first prong examines the proposed endeavor itself, including its substantial merit and its potential prospective impact at a level that supports a finding of national importance.

The second prong considers factors such as education, skills, knowledge, record of success, progress toward the endeavor, plans, support, interest, and other evidence showing the person is positioned to move the proposed work forward.

The third prong asks whether, considering the nature of the person's qualifications and proposed endeavor, it would be beneficial to the United States to waive the normal job offer and labor certification requirements.

The RFE response should define what you actually propose to do.
USCIS evaluates the specific proposed endeavor rather than simply asking whether the general occupation, industry, research field, or business sector is important.
For example, showing that artificial intelligence, cancer research, cybersecurity, energy, public health, or advanced manufacturing is important does not by itself establish that every proposed endeavor within that field has national importance.
The response should describe the proposed work with enough specificity to evaluate its prospective impact and then connect objective evidence to that particular endeavor.
Why does USCIS say the record is insufficient?
The Proposed Endeavor Is Too Broad or Vague
USCIS may be unable to assess national importance if the petition describes only a profession, industry, or general area of work rather than a sufficiently specific endeavor.
The Evidence Shows Merit but Not National Importance
A useful or valuable endeavor does not automatically have national importance. The response may need evidence demonstrating broader prospective impact or implications.
The Record Describes Past Work Without Connecting It to the Future Endeavor
Past achievements can be powerful evidence, but the response should explain how they demonstrate the person's ability to advance the particular endeavor proposed for the United States.
Letters Offer Conclusions Without Independent Support
Recommendation letters are more persuasive when their conclusions are supported by specific facts, objective evidence, and a clear explanation of the author's knowledge.
The Proposed Endeavor Depends on Future Plans That Are Not Documented
Business plans, partnerships, funding, customer interest, research programs, institutional support, contracts, or other evidence may help establish that the endeavor is concrete and realistically positioned for advancement.
The Third Prong Is Treated as Automatic
The petition should separately explain why the facts of the case justify waiving the normal job offer and labor certification process rather than assuming the first two prongs resolve that question.

Evidence of Prospective Impact
Government reports, industry data, independent research, economic or public-interest evidence, national initiatives, market evidence, or other objective sources can help establish why the specific endeavor has broader significance.
Evidence of Ability to Execute
Prior accomplishments, publications, patents, citations, contracts, funding, customer interest, institutional support, leadership, specialized expertise, implementation progress, and a detailed plan may show that the person can advance the endeavor.
Why a Waiver Makes Sense
The response should connect the person's particular qualifications, the nature and urgency of the endeavor, and the practical benefits of allowing the person to pursue the endeavor without the normal job offer and labor certification requirements.
Six principles for responding to an NIW RFE.
Define the Endeavor Precisely
State what the person proposes to do in the United States rather than describing only the occupation or general field.
Keep the Three Prongs Separate
Evidence of national importance does not automatically establish that the person is well positioned, and neither automatically resolves the third prong.
Use Objective Evidence
Independent documents can corroborate recommendation letters and provide context for the endeavor's importance and the person's record.
Connect Past Achievements to Future Work
Explain how the person's prior record demonstrates an ability to advance the proposed endeavor rather than simply listing accomplishments.
Show Progress, Not Just Intention
Where available, document concrete steps such as funding, contracts, research progress, collaborations, customer interest, or other support.
Answer the RFE USCIS Actually Issued
A response should track each finding in the notice and explain precisely how the supplemented record resolves it.
